Not Legal Advice
This page describes Fantasy365's practices and the legal precedents we rely on. It is not legal advice. If you have questions about your own use of sports data, consult a qualified attorney.
Fantasy365 is an independent fantasy sports platform. We are not affiliated with, endorsed by, sponsored by, or officially connected to Major League Baseball (MLB), the National Football League (NFL), the National Hockey League (NHL), the National Basketball Association (NBA), NASCAR, the NCAA, or any of their respective member teams, players' associations, or subsidiaries.
All team names, league names, and player names referenced on this platform are used solely for the purpose of identifying real-world sports entities in a fantasy game context. Such use does not imply any official relationship or endorsement.
Fantasy365 uses real player names and real-world performance statistics in its fantasy games. We rely on established legal precedent that the use of player names and publicly available statistics in fantasy sports games is protected expression under the First Amendment and does not violate players' right of publicity.
Key precedent: CBS Interactive Inc. v. National Football League Players Association (8th Cir. 2008) and CDM Fantasy Sports v. Major League Baseball Advanced Media (C.D. Mo. 2006).
We do not use player photographs, headshots, visual likenesses, or biographical content beyond what is necessary to operate the fantasy game (name, position, pro team, and on-field statistics).
Fantasy365 refers to professional and college sports teams by name and standard abbreviation (e.g., "Yankees" / "NYY") solely to identify which real-world team a player belongs to. This is nominative fair use — we use the name only to identify the entity, not to trade on the team's brand or goodwill.
We do not use:
All sport-specific visual elements on Fantasy365 (icons, field backgrounds, color schemes) are original designs created by us and do not replicate any league's or team's protected marks.
To stay clearly within the law, Fantasy365 does not:
League names, franchise names, chat messages, taunts, and other content created by Fantasy365 users are the responsibility of the users who create them. Users must not upload trademarked images, copyrighted photos, or content that violates the rights of third parties. We reserve the right to remove content that infringes on intellectual property rights.
If you believe Fantasy365 is using your name, image, or intellectual property in a way that is improper or unlawful, please contact us. We take all such reports seriously and will review and respond promptly.
